TERMS & CONDITIONS
ENTIRE AGREEMENT: This agreement contains the entire understanding between the COMPANY (Charlotte Wise Photography) and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The deposit stated in this contract is non-refundable. The only way to add to this agreement is to do so in writing, signed by all parties. If the CLIENT would like to amend their photography package to one with less value than the one booked, the contract will be terminated and a new non-refundable booking fee will be required. It is the CLIENTS decision as to whether they terminate their contract under the circumstance stated above and also their decision to sign a new contract with a new non refundable booking fee signed by both parties. By paying a non-refundable booking fee, you are agreeing to the Terms and Conditions in this contract.
ENGAGEMENT/PRE WEDDING PHOTOSHOOT: If you have booked a pre wedding/engagement photoshoot in your package, the payment for the photoshoot will be due 48 hours before your photoshoot. The remaining balance for your wedding photography package will be due four weeks before the wedding date stated in this contract.
RESERVATION: A signed contract and deposit are required to reserve the dates and times of the EVENT(S). If the EVENT(S) are rescheduled, postponed (including postponements due to COVID-19), or cancelled (including postponements due to COVID-19); or if there is a breach of contract by the CLIENT. The booking fee is non-refundable under any circumstance. The CLIENT shall also be responsible for payment for any of the COMPANY’s (Charlotte Wise Photography) materials charges incurred up to time of cancellation.
EVENT SCHEDULE: The client agrees to confirm the schedule four-weeks prior to the EVENT(S). Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the COMPANY (Charlotte Wise Photography) by the CLIENT. To ensure the aspects of the day the CLIENT would like captured is covered, it is the CLIENT's decison and responsibilty to book the appropriate amount of coverage (by the hour). The COMPANY (Charlotte Wise Photography) is not responsible for length of coverage - this has to be chosen by the client.
SAFETY: The COMPANY (Charlotte Wise Photography) reserves the right to terminate coverage and leave the location of the EVENT(S) if the photographer from the COMPANY (Charlotte Wise Photography) or any person hired by the COMPANY experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the EVENT(S); or in the event that the safety of the photographer from the COMPANY (Charlotte Wise Photography) or any person employed by Charlotte Wise Photography is in question.
SHOOTING TIME / ADDITIONS: The CLIENT and the COMPANY (Charlotte Wise Photography) agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the CLIENT does not arrive at the appointed time for the EVENT(S), shooting will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the CLIENT. During a full day booking (up to 7 hour’s coverage or more) the COMPANY (Charlotte Wise Photography) will at some point on the day of the EVENT(S) need to have a break and this time is included in the 7 hour's (or more) booked by the CLIENT in this contract. This will usually take place while the CLIENT and guests are having their reception meal so that no coverage is missed.
RESPONSIBILITIES: The COMPANY (Charlotte Wise Photography) is not responsible for compromised coverage due to causes beyond the control of the COMPANY (Charlotte Wise Photography) including but not limited to obtrusive guests, lack of co-operation during staged group photos including guests, lateness of the CLIENT/guests/wedding itself, unexpected traffic or road works, weather conditions, schedule complications, incorrect addresses provided to the COMPANY, rendering of decorations, or restrictions of the locations. The COMPANY (Charlotte Wise Photography) is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. The COMPANY (Charlotte Wise Photography) is not held liable for missed coverage of any part of the EVENT(S). The COMPANY (Charlotte Wise Photography) will not be held accountable for failure to deliver images of any individuals or any objects at the EVENT(S). Travel and parking expenses may be billed to the client depending on a number of factors, this can include fuel expenses, train tickets and overnight stays if this is applicable to your wedding. If there is a fuel charge added onto your package, this will be calculated 8 weeks before your wedding and an estimate will be provided at the time of booking.
EXCLUSIVE PHOTOGRAPHER: It is understood and agreed that no other photographer will be allowed to photograph or take pictures at the wedding while the Photographer is working unless employed by the COMPANY (Charlotte Wise Photography). The COMPANY (Charlotte Wise Photography) recommends you ask your guests do not take pictures during the entrance and exit of the ceremony as this could compromise the quality of your photos due to guests intruding in the images with cameras and camera phones. It is understood that wedding guests will of course want to take photos of the Bride and Groom, however, the photographer must be given precedence over your guests in order to take the wedding photographs required. The COMPANY (Charlotte Wise Photography) cannot be held responsible for lack of wedding photos if guests taking their own photos of the Bride and Groom have interrupted the photographer’s work.
MEALS & BREAKS: During a full day booking (up to 7 hour's coverage or more) the CLIENT agrees to provide a meal to the PHOTOGRAPHER(S) working on the day of the event (including the second shooter if you have booked one for a full day). It is requested that this happens at the same time the guests are eating so coverage is not compromised.
SECOND PHOTOGRAPHER: If you have booked a second photographer with the COMPANY (Charlotte Wise Photography), the chosen photographer is left to the discretion of the company (Charlotte Wise Photography). The chosen photos taken by the second photographer will be selected and edited by the COMPANY (Charlotte Wise Photography). In the unlikely event that the second photographer cannot make it to the EVENT due to circumstances beyond the control of the COMPANY (Charlotte Wise Photography), every effort will be made to find a replacement.
CO-OPERATION: The CLIENT will be responsible for, or have someone designated to, identify people of whom specific photographs are desired (formal family photos). Charlotte Wise Photography will not be held liable for anyone persons not included in the images. The client(s) will be able to choose a maximum of 6 group photos - excluding the bridal party portraits.
FILM and COPYRIGHTS: The photographs produced by the COMPANY (Charlotte Wise Photography) are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without the COMPANY’s (Charlotte Wise Photography) explicitly written permission. If the CLIENT has purchased an “Image Memory Stick/CD/Online Gallery” from the COMPANY (Charlotte Wise Photography), upon final payment by the CLIENT, limited copyright ownership of the resulting images will be transferred to the CLIENT. If the CLIENT has purchased an “Image Memory Stick/CD/Online Gallery” from the COMPANY (Charlotte Wise Photography), the COMPANY (Charlotte Wise Photography) grants the CLIENT permission to share the images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to the COMPANY (Charlotte Wise Photography). The CLIENT must obtain written permission from the COMPANY prior to publishing the photographs which must be signed by both parties. The CLIENT will be allowed to print their photos for non commercial use. Images taken by the COMPANY shall not be edited or altered in any way by the CLIENT or any third parties; any breach of this will result in legal action and charges.
PERSONAL ACCIDENT: Any directions issued to CLIENT, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
MODEL RELEASE: The CLIENT hereby assigns the COMPANY (Charlotte Wise Photography) the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT and their GUESTS may be included, for marketing, wedding blogs, editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The CLIENT releases all claim to profits that may arise from use of images.
ALBUM PRODUCTION: Due to weddings being booked far in advance, if you have added a Fine Art Album to your package, please note that the price of the album could change due to inflation and circumstances beyond the COMPANY’s (Charlotte Wise Photography) control. This price will be added onto your package. If you have purchased an album as part of your package, your album design proof will be sent to you before it goes into production - once this is approved by you, it cannot be changed. Although Charlotte Wise Photography uses the highest quality companies for album printing, Charlotte Wise Photography is not responsible for quality, colour differences, slight margin changes or material errors in the printed production.
Charlotte Wise Photography will design your album with images that compliment each other. Please let Charlotte Wise Photography know if there any specific images you would like to featured in the album no later than 4 weeks after receiving your wedding gallery. It may take 8 to 12 weeks for the album proof design to be complete. Charlotte Wise Photography is not responsible for album production timings or delivery timings once the proof has been submitted and accepted by the CLIENT. The process as a whole could take 4 to 6 months, providing images are chosen in the time scale above (Specific images to be chosen by the CLIENT no later than 4 weeks after receiving the proof).
LIMIT OF LIABILITY: In the unlikely event that the assigned photographer from the COMPANY (Charlotte Wise Photography) is unable to perform to the guidelines of this contract due to an injury, illness, act of terrorism, or other cause beyond the control of the COMPANY (Charlotte Wise Photography), the COMPANY (Charlotte Wise Photography) will make every effort to secure an associate photographer. If the situation should occur and an associate photographer is not found, responsibility and liability is limited to the return of all payments received for the EVENT(S). If the country of origin where the wedding is taking place is in full lockdown at the time the EVENT is due to take place due to viruses such as COVID-19 and SARS, Charlotte Wise Photography will offer a free postponement within 6 months of the original date (Postponement clause will then be actioned after this time scale). COVID-19 Related Postponement: If you need to reschedule/postpone your wedding due to a coronavirus lockdown, please let Charlotte Wise Photography know as soon as possible so your wedding date can be moved. If postponing within the same year, the final balance will still be payable on the original due date. If you are postponing to the year after, 50% of the balance will be payable on the original due date and the final 50% of the remaining balance 6 weeks before the new wedding date. If you are postponing due to a guest attendance limit, the normal postponement clause will apply.
CAPTURE AND DELIVERY: The COMPANY (Charlotte Wise Photography) is not liable to deliver every image taken at the event. The determination of images delivered to the CLIENT is left to the discretion of the COMPANY (Charlotte Wise Photography). In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the COMPANY’s (Charlotte Wise Photography) control, including but not limited to camera, hard drive, or equipment malfunction, the COMPANY (Charlotte Wise Photography) liability is limited to the return of all payments received for the EVENT(S). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. The COMPANY (Charlotte Wise Photography) is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package. The full gallery delivery will take 10-12 weeks (with a second photographer 12 to 16 weeks)*
*There are some instances where this time scale will be extended due to reasons beyond the control of Charlotte Wise Photography although all efforts will be made to ensure your gallery is delivered within the timescale above.
POST PRODUCTION AND EDITING: The final post production and editing styles, effects, and overall look of the images are left to the discretion of the COMPANY (Charlotte Wise Photography). Altering and re-editing of images is not permitted by the CLIENT or a third party is not permitted. The CLIENT will not receive every image taken at the EVENT. The final selection of images are left to the discretion of the COMPANY (Charlotte Wise Photography). All decisions made are in the best interest of the CLIENT who will be given the highest quality selection from the images taken. I understand the colouring and tones in the images will not be the same as in real life. A maximum of 45 images can have airbrushing and spot removal applied. Extensive editing such as dress strap removal, body transforming, stray hairs etc. will come at an additional cost.
PRINTING: Charlotte Wise Photography is not responsible for differences in colour and tone from on screen colour and tone to printed images.
PAYMENT SCHEDULE: The non-refundable deposit of 20% of the booking is due at the time of signing of agreement. The remaining balance is payable in full, no later than six weeks before the date of the EVENT(S) in this contract. In the event the CLIENT fails to remit payment as specified, the COMPANY (Charlotte Wise Photography) shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not attend the EVENT(S).
CANCELLATION: If the CLIENT has to cancel their contract with the COMPANY (Charlotte Wise Photography) and has already paid the booking fee, the booking fee will be non refundable under any circumstances (unless within the 14 day cooling off period of entering this contract). If the CLIENT cancels this contract six months before the wedding date stated in this contract, fifty percent of the remaining fee will need to be paid as a cancellation fee. If the CLIENT cancels this contract three months or less before the wedding date stated in this contract, the remaining fee will need to be paid in full as a cancellation fee. Cancellation fees will need to be paid no later than two weeks after the official cancellation has been made.
REFUNDS: Refunds for any add ons to the CLIENTS package (Wedding Album, Fine Art Book, Parent Album, USB Box, Engagement Shoot, Mounted Fine Art Prints, Print Packs, Second Photographer, Additional Hours, Fine Art Framed Photo & Add ons to Albums) cannot be refunded once the amount has been paid. If the CLIENT is purchasing an engagement shoot as part of their package, the price of the engagement shoot will be due 48 hour's before the scheduled shoot date. In the unfortunate event you are unsatisfied with your wedding photos, a refund will not be provided.
ARCHIVED IMAGES: The CLIENTS wedding photos will be archived by the COMPANY (Charlotte Wise Photography) for two years after your wedding day.
AMENDMENTS: Changes can be made to the CLIENTS package such as any add ons before or after the wedding day (except second photographer – at least three months notice will be needed). If the CLIENT needs to amend their contract to a smaller package with less hours, the existing contract will need to be terminated and the CLIENT will have to sign a new contract and pay an additional non refundable deposit. It is the CLIENTS decision to terminate the contract under these circumstances. It is also the CLIENTS decision to sign a new contract with the COMPANY (Charlotte Wise Photography). However, for additional hours the CLIENT will be able to keep the existing contract.
If you are moving or postponing your wedding date and Charlotte Wise Photography is not available on the rescheduled date, your booking fee will not be refunded. Package prices are subject to change if you are rescheduling/postponing your wedding date 3 or more months after the original wedding date in this contract. The price difference will be added to your original package price.
LATE FEES: The remaining balance will be required no later than six weeks before the date stated for the EVENT(S) in this contract. If the payment is late, there will be 1.5% charge on top of the total amount every day after the deadline until the amount is paid in full.
